Terms and Conditions

In compliance with Article 1-1 of the Law No. 2004-575 of June 21, 2004, known as the "Loi pour la Confiance dans l'Économie Numérique" (LCEN), the following information is provided to users of the Site:

These Terms define the conditions under which any individual or legal entity (hereinafter "the User") may access and use the Site and the services offered by Migue Studio. By accessing the Site, the User unreservedly accepts these Terms in their entirety.

Migue Studio reserves the right to modify these Terms at any time. The applicable version is the one published on the Site at the time of the User's visit. Users are encouraged to review these Terms periodically.

Migue Studio provides digital services in the following areas:

• Process diagnosis: Analysis of the client's existing business processes to identify inefficiencies and recommend which automation or AI solutions would provide the greatest impact, prior to any implementation.
• Operations automation: Design and implementation of intelligent automation solutions using artificial intelligence, including automated workflows and custom integrations that eliminate repetitive manual tasks for businesses.
• 24/7 virtual assistant: A custom conversational AI assistant integrated into the client's web chat and WhatsApp, providing continuous customer support, answering questions, and capturing client information automatically. If the client subscribes to the phone option, the assistant can also answer the client's phone line and book during the call. The assistant's name and identity are defined by each client.
• AI that answers from client documents: Implementation of AI assistants connected to the client's own documentation (manuals, policies, internal procedures) that answer from those documents and say so when the answer is not in them, rather than relying on general knowledge.

Detailed information about each service, including pricing and specific terms, is provided upon request and formalized in individual service agreements where applicable.

The Site is accessible free of charge to any User with internet access. All costs related to accessing the Site (hardware, software, internet connection) are borne by the User.

Migue Studio strives to maintain the Site accessible 24/7 but cannot guarantee uninterrupted availability. Access may be temporarily suspended for maintenance, updates, or due to circumstances beyond its control (force majeure, technical failures, etc.) without prior notice or liability.

By using the Site, the User agrees to:

• Use the Site and services in good faith and in compliance with applicable French and European laws
• Refrain from using the Site or its AI features to send spam, automated requests or content that infringes the rights of others
• Refrain from attempting to access the Site, its servers or connected services without authorization, or to disrupt or overload them
• Ensure all interactions with Elsa, the Site's AI assistant, are lawful and do not generate prohibited content
• Provide accurate and truthful information when contacting Migue Studio or using its services

Failure to comply with these obligations may result in the suspension of access to the Site, without prejudice to any legal action that Migue Studio may take.

All content on the Site, including but not limited to text, graphics, logos, images, photographs, videos, audio, software, code, UI/UX designs, and the overall structure, is the property of Miguel Sánchez, who publishes the Site as Migue Studio, and is protected by French intellectual property law (Code de la Propriété Intellectuelle), as well as international copyright and trademark conventions.

Any reproduction, representation, distribution, modification, or adaptation of any part of the Site or its content, by any means, without the prior written consent of its owner, is strictly prohibited and constitutes an infringement punishable under Articles L.335-2 et seq. of the French Intellectual Property Code.

Migue Studio develops and deploys conversational AI assistants for its clients, using language models. In compliance with the EU Artificial Intelligence Act (Regulation 2024/1689), the User is hereby informed of the following:

• AI disclosure: Elsa, this Site's assistant, is an artificial intelligence system, not a person: her replies are generated by a language model.
• No guarantees: Elsa's responses are for informational purposes only and do not constitute professional advice (legal, medical, financial, or otherwise). Migue Studio is not liable for decisions made based on content generated by the AI.
• Data processing: Conversations with Elsa may be stored and analyzed to improve the service, in accordance with the Privacy Policy and the GDPR.
• Human oversight: The User may request human review of any AI interaction at any time by writing to info.miguestudio@gmail.com.

Migue Studio endeavors to ensure the accuracy of the information published on the Site. However, it cannot guarantee the completeness, accuracy, or timeliness of all information provided.

Migue Studio shall not be held liable for:

• Any interruption or temporary unavailability of the Site
• Any direct or indirect damage resulting from the use or inability to use the Site
• The content of external websites linked from the Site
• Any security breach beyond reasonable technical measures
• Any inaccuracy or error in the responses generated by the AI

The Site may contain hyperlinks to external websites. Migue Studio has no control over the content of these sites and assumes no responsibility for their content, privacy practices, or availability. Following these links is at the User's own risk.

Creation of hyperlinks to the Site without prior written authorization from Migue Studio is prohibited if it would create the appearance of an association, endorsement, or sponsorship that does not exist.

The Site uses strictly necessary technical cookies to ensure its proper functioning. In compliance with the CNIL (Commission Nationale de l'Informatique et des Libertés) guidelines and the ePrivacy Directive, these essential cookies do not require prior consent.

The Site also uses Google Analytics 4 (GA4) for audience measurement. This analytics cookie is only activated after obtaining the User's explicit consent via the cookie consent banner displayed on their first visit, in accordance with CNIL Recommendation 2020-091 of September 17, 2020. The User may change or withdraw their consent at any time from the "Cookies" link in the footer.

The collection and processing of personal data through the Site is governed by the Privacy Policy, which constitutes an integral part of these Terms.

In compliance with the GDPR (Regulation (EU) 2016/679) and the French Data Protection Act (Loi Informatique et Libertés of January 6, 1978, as amended), Users have the right to access, rectify, erase, restrict processing, data portability, and object to the processing of their personal data, as detailed in the Privacy Policy.

In accordance with Articles L.221-18 et seq. of the French Consumer Code (Code de la consommation), for services contracted at a distance, the consumer has a right of withdrawal of 14 calendar days from the date of conclusion of the contract, without the need to justify any reason.

To exercise the right of withdrawal, the User must send a clear, unambiguous notification to info.miguestudio@gmail.com before the withdrawal period of 14 days expires.

In accordance with Articles L.611-1 to L.616-3 of the French Consumer Code, in the event of a dispute that could not be resolved through a prior complaint made to Migue Studio, the consumer has the right to resort to free consumer mediation.

The User may contact the competent consumer mediator.

These Terms are governed by and construed in accordance with French law. Any dispute arising from the use of the Site or the services of Migue Studio shall be subject to the exclusive jurisdiction of the competent French courts, unless otherwise required by mandatory consumer protection provisions.

In the event of a dispute with a consumer residing in the European Union, the consumer retains the option to bring proceedings before the courts of the Member State where they are domiciled, in accordance with Regulation (EU) No. 1215/2012 (Brussels I Recast).
