These Terms define the conditions under which any individual or legal entity (hereinafter "the User") may access and use the Site and the services offered by Migue Studio. By accessing the Site, the User unreservedly accepts these Terms in their entirety.

Migue Studio reserves the right to modify these Terms at any time. The applicable version is the one published on the Site at the time of the User's visit. Users are encouraged to review these Terms periodically.

Migue Studio provides digital services in the following areas:

• AI Automation — Design and implementation of intelligent automation solutions using artificial intelligence, including conversational assistants, automated workflows (n8n), and custom AI integrations for businesses.
• Digital Marketing — Strategy, content creation, social media management, SEO optimization, and digital advertising campaigns.
• Web Design & Development — Creation of modern, AI-powered websites and web applications, offering advanced integrations that surpass traditional development, alongside premium UI/UX design.
• AI-Powered Virtual Assistant (Elsa) — A conversational AI assistant embedded on the Site that provides information about services, answers questions, and facilitates client communication.

Detailed information about each service, including pricing and specific terms, is provided upon request and formalized in individual service agreements where applicable.

The Site is accessible free of charge to any User with internet access. All costs related to accessing the Site (hardware, software, internet connection) are borne by the User.

Migue Studio strives to maintain the Site accessible 24/7 but cannot guarantee uninterrupted availability. Access may be temporarily suspended for maintenance, updates, or due to circumstances beyond our control (force majeure, technical failures, etc.) without prior notice or liability.

By using the Site, the User agrees to:

• Use the Site and services in good faith and in compliance with applicable French and European laws
• Engage with the Site and its AI features responsibly, refraining from activities that violate our acceptable use policies
• Respect the integrity of our digital infrastructure, which is protected by advanced security protocols
• Ensure all interactions with our AI assistant are lawful and do not generate prohibited content
• Provide accurate and truthful information when contacting us or using our services

Any violation of these conditions will trigger our automated security protocols and may result in the immediate suspension of access to the Site, without prejudice to any legal action that Migue Studio may undertake.

All content on the Site — including but not limited to text, graphics, logos, images, photographs, videos, audio, software, code, UI/UX designs, and the overall structure — is the exclusive property of Migue Studio and is protected by French intellectual property law (Code de la Propriété Intellectuelle), as well as international copyright and trademark conventions.

Any reproduction, representation, distribution, modification, or adaptation of any part of the Site or its content, by any means, without the prior written consent of Migue Studio, is strictly prohibited and constitutes an infringement punishable under Articles L.335-2 et seq. of the French Intellectual Property Code.

The Site features an AI-powered assistant named Elsa, which uses advanced language models. In compliance with the EU Artificial Intelligence Act (Regulation 2024/1689), the User is hereby informed of the following:

• AI Nature Disclosure: Elsa is an artificial intelligence system, not a human. All interactions are machine-generated.
• No Guarantees: Responses provided by the AI assistant are for informational purposes only and do not constitute professional advice (legal, medical, financial, or otherwise). Migue Studio is not liable for decisions made based on AI-generated content.
• Data Processing: Conversations with Elsa may be stored and analyzed for service improvement purposes, in accordance with our Privacy Policy and the GDPR.
• Human Oversight: The User may request human review of any AI interaction at any time by contacting us directly.

Migue Studio endeavors to ensure the accuracy of the information published on the Site. However, it cannot guarantee the completeness, accuracy, or timeliness of all information provided.

Migue Studio shall not be held liable for:

• Any interruption or temporary unavailability of the Site
• Any direct or indirect damage resulting from the use or inability to use the Site
• The content of external websites linked from the Site
• Any security breach beyond reasonable technical measures
• Any inaccuracy or error in AI-generated responses

The Site may contain hyperlinks to external websites. Migue Studio has no control over the content of these sites and assumes no responsibility for their content, privacy practices, or availability. Following these links is at the User's own risk.

Creation of hyperlinks to the Site without prior written authorization from Migue Studio is prohibited if it would create the appearance of an association, endorsement, or sponsorship that does not exist.

The Site uses strictly necessary technical cookies to ensure its proper functioning. In compliance with the CNIL (Commission Nationale de l'Informatique et des Libertés) guidelines and the ePrivacy Directive, these essential cookies do not require prior consent.

Any analytics or tracking cookies, if implemented, will require explicit consent from the User via a cookie consent banner, in accordance with CNIL Recommendation 2020-091 of September 17, 2020. Users may manage their cookie preferences through their browser settings at any time.

The collection and processing of personal data through the Site is governed by our , which constitutes an integral part of these Terms.Privacy Policy.

In compliance with the GDPR (Regulation (EU) 2016/679) and the French Data Protection Act (Loi Informatique et Libertés of January 6, 1978, as amended), Users have the right to access, rectify, erase, restrict processing, data portability, and object to the processing of their personal data, as detailed in our Privacy Policy.

In accordance with Articles L.221-18 et seq. of the French Consumer Code (Code de la consommation), for services contracted at a distance, the consumer has a right of withdrawal of 14 calendar days from the date of conclusion of the contract, without the need to justify any reason.

To exercise the right of withdrawal, the User must send a clear, unambiguous notification to info.miguestudio@gmail.com before the expiration of the 14-day period.

In accordance with Articles L.611-1 to L.616-3 of the French Consumer Code, in the event of a dispute that could not be resolved through a prior complaint made to Migue Studio, the consumer has the right to resort to free consumer mediation.

The User may contact the competent consumer mediator or use the European Online Dispute Resolution (ODR) platform available at: ec.europa.eu/consumers/odr

These Terms are governed by and construed in accordance with French law. Any dispute arising from the use of the Site or the services of Migue Studio shall be subject to the exclusive jurisdiction of the competent courts of Saint-Denis de La Réunion, France, unless otherwise required by mandatory consumer protection provisions.

In the event of a dispute with a consumer residing in the European Union, the consumer retains the option to bring proceedings before the courts of the Member State where they are domiciled, in accordance with Regulation (EU) No. 1215/2012 (Brussels I Recast).
